How Mediation Works

Mediation is a confidential, structured process that helps people resolve disputes without going to court. A neutral third party — the mediator — guides the conversation and helps both sides work toward a mutually acceptable agreement.

Unlike a judge or arbitrator, the mediator does not make decisions or take sides. Instead, the mediator helps clarify issues, improve communication, and explore practical solutions. In many cases an agreement can be reached within a two hour session. 

Step 1: Initial Contact & Scheduling

The process begins when both parties agree to mediate. We coordinate scheduling, explain the process, and gather basic information about the dispute. Mediation can be held in person or virtually, depending on your needs.

Step 2: Mediation Session

At the mediation session, the mediator outlines the ground rules and ensures both parties understand the confidential nature of the process. Each party has the opportunity to share their perspective without interruption.

 

Guided Discussion

The mediator facilitates productive dialogue to identify key issues and areas of disagreement. The focus is on understanding concerns, clarifying misunderstandings, and exploring possible solutions.

Private Meetings (If Needed)

In many cases, the mediator may meet privately with each party. These confidential conversations allow participants to speak openly about concerns and settlement options.

 

Negotiation & Resolution

With the mediator’s guidance, the parties work toward a voluntary agreement. If a resolution is reached, the terms can be documented in writing and may become legally binding.

Arbitration is a more formal ADR process, but still far more flexible and efficient than court proceedings. An independent arbitrator listens to each side, considers the evidence, and makes a decision that is usually binding. Arbitration provides clarity and finality while remaining private and tailored to the needs of the parties.
